Procedure of Bail Application

The court has the right to remand the person in custody for a limited duration or set the person free with any, some or all of the following conditions, to be activated if he breaks bail conditions:

Personal guarantee: Suspect signs a document stating that he will be liable to pay the set amount.

Guarantor’s guarantee: A person other than the suspect signs a document stating that he will be liable to pay the set amount, providing satisfactory proof at the time of signing that he is able to procure such amount if necessary.

Deposit of money: An amount set by the court is deposited in the court account.

Signature: The suspect reports to a police station at specified intervals.

Limitation of Movement: The suspect is limited to remain in a specific location.

The court, in deciding to set bail conditions, may review what the alleged offence is, what is the evidence connecting the suspect to the alleged offence, what would be the punishment of the court if the suspect is found guilty, status of the potential guarantors, how likely it is that the suspect would attend to court and not flee the country.
