Trade Marks
Registration of your trade mark in North Cyprus gives you secure rights in order to protect your intellectual property and bring legal action against who use your trade mark without your permission.
For the best protection of your trade mark, you can register it under chapter 268 Trade Marks Law. Such registration gives the owner of the trademark right to use it exclusively. If you have registered your trade mark, in case of someone using it without your permission, it is unlikely that you will have difficulty as to who the trade mark belongs to.
If you have not registered your trade mark, before any legal proceedings are initiated under this law, it may be advisable to complete the registration. The lawsuits to be filed under this law are directly filed to the Supreme Court.
Passing Off
If by imitation of name, description, sign, label or otherwise anybody causes someone else to mistakenly believe that they are purchasing your product, you can bring legal action against the imitator.
This way of bringing legal action can be used regardless of your trade mark being registered or not. Lawsuits under this heading are filed in the District Court.
